Suing JUUL for Deceptive & Dangerous Marketing Tactics

E-cigarettes and vaping devices like JUUL – which is believed to be the most popular among them – are under fire lately for using misleading marketing to put people at risk. The demographic most affected by their deception is, unfortunately, teens and youths, who were told JUULing was a safe alternative to smoking tobacco cigarettes.

People are standing up for themselves and bringing a legal fight to JUUL’s doorstep, and Fibich, Leebron, Copeland & Briggs in Houston is helping. We are currently hearing from people who have used a JUUL or vaping device and now suffer from either a nicotine addiction or a pulmonary health condition. Depending on the details of your situation, you may be able to bring a lawsuit against JUUL in pursuit of justice, closure, and compensation.

How Did JUUL Deceive the Nation’s Youth?

According to research from independent groups and internal information from JUUL, much of the company’s marketing tactics were geared towards reaching children, teens, and young adults. In fact, JUUL became a recognized name after it began selling “fun-flavored” vaping products, like cherry, mango, and cotton candy.

Just how badley has the JUULing craze gripped America’s teenage population? The NIDA and Truth Initiative report:

  • Approximately 12% of high schoolers vape, up from about 2.5% in 2011
  • 66% of teens who vape admitted to using a tobacco product within a month of first using an e-cig
  • 66% of teen vapers thought there was only flavoring in their e-cigarette product or JUUL
  • About 33% of vaping teens will switch to regularly using cigarettes within six months of starting

The National Institute on Drug Abuse (NIDA) found JUUL ads targeted teens through:

At one point, JUUL representatives were even sent to schools to tell students that JUULing was a “safe alternative” to smoking because the device contained no tobacco. During these same conferences, students were not clearly told that JUUL devices contained nicotine, a dangerously addictive substance that can cause a number of health consequences, including stunting brain cell development.

JUUL was also lambasted by the Food and Drug Administration (FDA) and the Centers for Disease Control and Prevention (CDC) for selling its products as a “cigarette alternative” without providing any scientific backing that vaping could actually deter cigarette use. If anything, the nicotine in JUULs seems to only increase the chances of a teenager picking up a cigarette later on.

Targeting Teens Was No Mistake

In December 2018, it was uncovered that Altria made a major $12.8 billion investment in JUUL Labs, which was valued at about $38 billion at the time. Altria is one of the country’s largest tobacco product manufacturers. Why a company that sells cigarettes would want to invest in a product that allegedly “stops people form smoking” was initially unclear.

However, after the investment became public, people began to connect the dots. JUUL packaging and marketing was suspiciously similar to those of cigarette products, right down to color scheme in some ads. Mini marts were also instructed by JUUL to place their products on the front counter and in clear sight of cigarette products, which looked strikingly similar. If a teenager was on the fence about to JUUL or to smoke, then these deliberate overlaps would likely tip them to cigarette use.

JUULing is Not Safe at All, CDC Warns

Following the deaths of 26 people across 21 states, the CDC has officially warned that all e-cigarette, vaping device, and JUUL products should not be used under any circumstance. According to initial research, using a JUUL product regularly can cause a rare pulmonary disease that triggers potentially-fatal breathing complications. Lawsuits have already been filed against JUUL for the loss of loved ones who appear to have passed away due to vape-related illnesses.

Health problems that have been associated with regular JUUL usage include:

  • Cardiovascular complications
  • Insomnia
  • High blood pressure
  • Stroke
  • Pneumonia
  • Ulcers and gastrointestinal illness

Withdrawal symptoms from nicotine addiction can also include uncontrolled mood swings and mental health concerns, such as anxiety, depression, and mania. If your teen vapes and has been acting highly unusual lately, then it very well could be caused directly by their e-cigarette product or JUUL device.

While the range of defective product lawsuits is broad, most product liability claims fall into the following categories:

  • Defective manufacture: The most obvious type of product liability claims is when a product is flawed due to an error in the manufacturing process, causing it to be somehow different from others like it. These types of claims typically involve products that are dangerous due to low-quality materials or shoddy workmanship.
  • Design defect: These types of claims arise when a product is inherently dangerous due to a flaw its design, even though it may be manufactured perfectly. An example of this would be an SUV that has a high rollover risk due to its top-heavy design.
  • Failure to warn: Some products such as power tools carry some level of risk and require certain precautions to be operated safely. In these cases, manufacturers have a duty to provide adequate warnings about a product’s proper use to keep consumers safe. An example of this would be a prescription medication that does not include a proper warning label about dangerous side effects that can occur if taken with another common medication, such as aspirin.
