Attorney Greg Fibich of Fibich, Leebron, Copeland & Briggs is currently representing a Texas mother who has filed a lawsuit against Children’s Universe of Lake Conroe, a daycare facility responsible for the care of her four-year-old son. The lawsuit alleges that the teachers at the facility encouraged young children, including her son, to fight each other on the playground. One of these incidents was even caught on camera and shared on social media.
The concerned mother suspected that something was going on with her son for months, but had a hard time getting answers. After discovering unexplained injuries on her son, she asked to speak with someone at the day care, but her calls were never returned and her questions were left unanswered. It was only when she received a call from the Texas Department of Family and Protective Services that she learned of the video that had been posted to the Internet of her son fighting another child. The video evidence revealed that the teachers incited the violence and encouraged the fight.
The cell phone video clearly shows the two boys hitting and kicking each other. In an interview with the mother, she shared her outrage at the fact that, when the video shows her child knocked down, a teacher’s voice is heard telling him to “get up and fight.”
Outraged, the mother filed a lawsuit against the Houston-area daycare for what she calls “sick” and “sadistic” behavior by teachers. The director of the daycare maintains that the staff has cooperated fully with authorities and that she was the one who initially reported the incident. She also told authorities that the teacher who allegedly shot the video was terminated for “unrelated reasons” prior to the report. Now, however, this teacher has stepped forward, claiming that she was responsible only for leaking the video, not filming it.
This teacher claims that she shared the video on social media because she felt that she was wrongfully terminated. “I’m the whistleblower,” she says.
Criminal charges have also been filed. The story has received a significant amount of local news coverage in outlets like KHOU-CBS 11, KPRC-NBC 2, KTRK-ABC 13, KIAH- Newsfix CW 39, the Conroe Courier, and the Houston Chronicle.
Attorney Fibich is helping the mother pursue justice by holding the facility accountable for their misconduct. “It is shocking that this could happen,” he says.
The mother, who researched the facility to ensure that her child would be in good hands, also expressed her disbelief that something like this could happen. “I was livid to think that someone could be so sick…these little boys are four years old. They’re babies.”
